CLINICAL ESTABLISHMENTS

(REGISTRATION & REGULATION) ACT, 2010 IN THE STATE OF MIZORAM

INTRODUCTION:

The Clinical Establishments (Registration & Regulation) Act, 2010 was passed by Parliament on August, 18th, 2010 and notified in the Gazette of India on 1st March, 2012. The implementation of this Act is being monitored by the PMO. The Government if India had already constituted a National Council for Clinical Establishments and notified in the Gazette of India on 19th March’2012. On 1st June, 2012 first meeting of National Council held. Rules by Centre were notified on 23rd May, 2012.

The Mizoram Clinical Establishments (Registration & Regulation) Rules 2014 has been prepared by the Department of Health & Family Welfare. The said Rules is already notified in the Mizoram Gazette. However, laying of the Rules in the Assembly awaited.

RATIONALE FOR THE PROGRAMME:

The Clinical Establishments (Registration & Regulation) Act, 2010 passed by the Parliament applies to the whole States of Arunachal Pradesh, Rajasthan, Jharkhand, Uttar Pradesh, Himachal Pradesh, Mizoram, Sikkim and the Union Territories of Chandigarh, Puducherry, Andaman & Nicobar Islands, Dadra & Nagar Haveli, Daman & Diu, Lakshadweep.

MANAGEMENT & STRUCTURE FOR EFFECTIVE MANAGEMENT:

The State Council for Clinical Establishments has been constituted and notified by the Government of Mizoram. The State Council for the Clinical Establishment consists of members as specified under the Clinical Establishment Act (Registration & Regulation), 2010 and the rules made thereof i.e. the Mizoram Clinical Establishments (Registration & Regulation) Rules 2014. Also, the Government of Mizoram notified the District Registering Authority, consisting of members as specified under the Act and the rules made thereof.
